Terms of Service

Welcome to StillWords. These Terms of Service ("Terms") govern your use of the StillWords mobile application ("App") operated by Euler Works LLC ("we", "us", or "our"). By downloading, accessing, or using StillWords, you agree to be bound by these Terms.

1. ACCEPTANCE OF TERMS

By creating an account or using StillWords, you confirm that:

• You are at least 13 years of age (or the minimum age required in your jurisdiction)
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• You have read and understood our Privacy Policy

2. DESCRIPTION OF SERVICE

StillWords is an AI-powered mobile application that transforms your photos into personalized poetry. Our service includes:

• Photo-to-Poetry Generation: Upload photos and receive AI-generated poems based on the image content
• Multiple Moods: Choose from various emotional tones including romantic, humorous, roast, and more
• Multi-Language Support: Generate poems in multiple languages
• Style Customization: Customize fonts, colors, and layouts for your poems
• Library: Save and manage your created poems
• Export & Share: Export poems as images and share on social media

3. USER ACCOUNTS

3.1 Account Creation

You may create an account using Apple Sign-In, Google Sign-In, or email authentication. You are responsible for:

• Providing accurate and complete information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

3.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. SUBSCRIPTION AND PAYMENTS

4.1 Free Tier

StillWords offers a limited free tier that allows you to generate a certain number of poems. Free users are subject to daily usage limits.

4.2 Premium Subscriptions

We offer premium subscription plans ("StillWords Pro") that provide:

• Unlimited poem generation
• Access to all moods and languages
• Priority processing
• No advertisements

4.3 Billing

• Subscriptions are billed through Apple's App Store
• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your App Store account settings

4.4 Refunds

Refunds are handled according to Apple's App Store refund policies. We do not directly process refunds for subscription purchases.

5. USER CONTENT

5.1 Your Content

You retain ownership of any photos you upload to StillWords. By uploading content, you grant us a limited, non-exclusive license to:

• Process your photos through our AI system to generate poetry
• Temporarily store your photos for processing purposes
• Display your content back to you within the App

5.2 Content Restrictions

You agree not to upload content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Contains explicit or adult material
• Infringes on intellectual property rights of others
• Contains malware or harmful code
• Violates the privacy of others

5.3 AI-Generated Content

Poems generated by StillWords are created using artificial intelligence. While we strive for quality:

• We do not guarantee the accuracy, appropriateness, or quality of generated content
• Generated poems may occasionally contain unexpected or inappropriate content
• You are responsible for reviewing generated content before sharing

6. INTELLECTUAL PROPERTY

6.1 Our Property

StillWords, including its design, features, functionality, and underlying technology, is owned by Euler Works LLC and protected by copyright, trademark, and other intellectual property laws.

6.2 Your License to Generated Poems

You are granted a personal, non-exclusive, worldwide license to use, share, and display poems generated for you through StillWords for personal and non-commercial purposes.

7. PROHIBITED USES

You agree not to:

• Use the App for any illegal purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Use automated systems or bots to access the service
• Interfere with or disrupt the App's functionality
• Circumvent usage limits or subscription requirements
• Resell or redistribute generated content commercially without permission
• Use the App to generate harmful, defamatory, or abusive content

8. DISCLAIMER OF WARRANTIES

StillWords is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the service will be uninterrupted or error-free
• Warranties regarding the accuracy or reliability of AI-generated content

9. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Euler Works LLC shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Any damages arising from your use or inability to use the App
• Any content generated by the AI system

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. INDEMNIFICATION

You agree to indemnify and hold harmless Euler Works LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of StillWords
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload to the App

11. THIRD-PARTY SERVICES

StillWords integrates with third-party services including:

• Google Gemini AI: For AI-powered poetry generation
• Supabase: For authentication and data storage
• Apple/Google Sign-In: For account authentication

Your use of these services is subject to their respective terms and privacy policies.

12. MODIFICATIONS TO SERVICE

We reserve the right to:

• Modify or discontinue any feature of StillWords at any time
• Update these Terms with reasonable notice
• Change subscription pricing with advance notice to existing subscribers

Continued use of the App after changes constitutes acceptance of the modified Terms.

13. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction.

14. SEVERABILITY

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Euler Works LLC regarding your use of StillWords.

By using StillWords, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
